These terms govern your use of this website and any order you place through it. By using the site or placing an order you accept them. If you do not accept them, please do not use the site.
1. About us
This site is operated by Wholesome Labs. You can contact us about anything on this page at hello@wholesomelabs.co.
2. Eligibility and buyer status
By placing an order you represent and warrant that:
- You are at least 21 years of age.
- You are a qualified professional, or are purchasing on behalf of an institution, acting within the scope of laboratory research.
- You have the training, facilities and authority appropriate to receiving, handling, storing and disposing of research materials.
- The information you provide at checkout, including the research field you declare, is accurate.
We may decline or cancel any order where these conditions do not appear to be met.
3. Products and research use restriction
All products sold through this site are supplied strictly for laboratory research purposes. By placing an order you acknowledge and agree that:
- Products are for laboratory research use only.
- Products are not for human consumption and must not be administered to humans or animals.
- Products are not drugs, foods, cosmetics, medical devices or dietary supplements.
- Products are not intended for the diagnosis, treatment, cure, mitigation or prevention of any disease or condition.
- No representation is made as to the suitability of any product for any particular purpose.
This acknowledgment is presented and must be accepted at checkout before an order can be completed.
We publish no guidance on use, dosing, reconstitution or administration, and we will not provide any on request. Nothing on this site is medical, veterinary or scientific advice.
4. Accounts
An account is required to place an order; we do not offer guest checkout. You are responsible for the accuracy of your account details, for keeping your password secure, and for everything done through your account. Tell us promptly at hello@wholesomelabs.co if you believe it has been used without your permission.
One person or institution per account. Accounts may not be shared, sold or transferred.
5. Orders and acceptance
An order placed through the site is an offer to buy. It is accepted, and a contract formed, only when we send an email confirming that the order has been dispatched. An order confirmation acknowledging receipt is not acceptance.
We may decline or cancel an order at our discretion, including where a product is unavailable, where we cannot verify the information given, where the order appears to be for a purpose outside laboratory research, or where a pricing or description error has occurred. If we cancel an order you have already paid for, we refund it in full.
Product listings describe what is supplied. Where a certificate of analysis has been published for a lot, it is linked on the product page and listed in the COA Library.
6. Pricing, payment and tax
Prices are shown on each product page and are exclusive of shipping, which is calculated at checkout. Volume pricing is applied automatically based on the total number of vials in the order, and is shown before you pay.
Payment is taken at the time the order is placed. Card details are handled by our payment processor and are never stored on this site.
7. Delivery
Orders are shipped to street addresses only. We do not deliver to PO Box addresses, and the checkout will not accept one. The shipping policy covers processing times, destinations, tracking and delivery problems.
You are responsible for giving a correct and complete delivery address, and for ensuring that receiving the products is lawful where you are.
8. Cancellations, returns, refunds and chargebacks
Our refund and cancellation policy sets out the cancellation window, the conditions under which a return is accepted, how refunds are made, and how payment disputes are handled. It forms part of these terms.
Because these are research materials, we cannot accept the return of a vial once it has left our control except where it arrived damaged, incorrect or defective. Please contact us before returning anything.
9. Assumption of risk
Research materials carry inherent risk. You accept that you are solely responsible for evaluating whether a product is appropriate for your work, for the conditions under which it is received, handled, stored and disposed of, and for compliance with every law, regulation, institutional policy and safety requirement that applies to you.
You accept that risk knowingly and voluntarily.
10. Disclaimer of warranties
Products are supplied as they are. To the fullest extent the law allows, we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Where a certificate of analysis is published, it reports what the testing laboratory found for that lot on that date. It is not a warranty of performance, of suitability for your work, or of any result.
We do not warrant that the site will be uninterrupted or error free.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, data or research, however caused.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
12. Indemnification
You agree to indemnify, defend and hold harmless Wholesome Labs, its officers, directors, employees, agents and suppliers from and against any claims, liabilities, damages, losses, penalties, costs and expenses, including reasonable legal fees, arising out of or connected with your purchase, handling, storage, use, resale, transfer or disposal of any product obtained through this site, or your breach of these terms. This clause survives termination of these terms.
13. Acceptable use of this site
You may not:
- Give false information, including a false age, research field or delivery address.
- Order for onward supply to anyone who could not order directly, or resell products as suitable for human or veterinary use.
- Represent our products as approved, or make claims about what they do, in any listing or material of your own.
- Interfere with the site, attempt to gain unauthorized access, or scrape it by automated means.
- Use the site for anything unlawful.
14. Intellectual property
The content of this site — text, photography, product imagery, layout, and the Wholesome Labs name and marks — belongs to us or our licensors and is protected by intellectual property law. You may view and print pages for your own reference. You may not copy, republish or use them commercially without our written permission.
Certificates of analysis may be downloaded and shared unmodified. Third-party names and marks appearing on the site remain the property of their owners.
15. Suspension and termination
We may suspend or close an account, and decline to supply, where these terms are breached, where information given proves inaccurate, or where an order appears to be for a purpose outside laboratory research. You may close your account at any time by asking us.
Sections that by their nature should survive — including research use restriction, disclaimer of warranties, limitation of liability and indemnification — continue to apply after an account closes.
16. Governing law and disputes
If something goes wrong, contact us first at hello@wholesomelabs.co. Most problems are quicker to fix directly than formally.
17. Changes to these terms
We may update these terms. The version published on this page at the time you place an order is the version that governs that order. Where a change is material we will tell account holders by email.
18. General
If any part of these terms is found unenforceable, the rest continues to apply. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms without our consent; we may transfer ours if the business is sold or reorganized.
These terms, together with the privacy policy, shipping policy, refund and cancellation policy and research use disclaimer, are the whole agreement between us about your use of this site.
